How Courts Could Affact Brown CaseBy DrAbuelo(2,637) Race And U.S. School SystemToday the Supreme court could make a decision that could change to face of several schools nation wide. The case thats on the floor centers around the question of wether race can be used to determine where a child goes to school. Now several questions and concerns will be immediately raised in the court room. First, if the decision made by the high court further segregates U.S. publics, how can we accept a separate but, equal sales pitch that will undoubtedly leave children of color in a state of further disadvantage. However, If your child loses out in going to the public school of their choice due to the issue race when all else is equal, should they be forced to travel an hour or more to get to the next nearest school? But, most importantly is how is this high court decision going to affect the landmark case Brown v.s. The Board Of Education. The issue in the case is this, does any school have the right to accept or deny a student from going to their school based on race for the purpose of keeping a wide diversely of students in their schools system. For those who support this policy, they argue that without such a policy or program, the decision made in the 1954 case of Brown vs the board of education could be seriously compromised. Even with these programs, the US public schools are still more segregated now than they were twenty years. In fact, integrated schools are holding on to the last rung of the ladder to survive. If history has taught us anything, it is that the populations with the most access to resources invariably have the best schools with the the best teachers and thus the students in these schools have such a huge advantage that the statues quo will only continue to work against the poor people of the country. With this said however, one must also ask the question of what happens to children in the long term that are forced to travel an hour or more one way just to get to school, all in the name of the creation of a quasi utopia. Its hard to argue against these peoples concerns when they have a high school right next door. In these cases, you are also risking separating students from their friends and in some cases, their support group. Finally, the question over hispanic students has yet to be addressed. In a country that bases most of their categorizations on the color of ones skin, you leave the door wide open to those that fall into that huge umbrella category we know as hispanic. The list in this community ranges from African ancestry to Europeans and Asians. How does this fit in the puzzle when deciding how the laws are going to read. At this point we can only guess but, if history is any indication, expect a noncommittal answer to come from the courts. For more on this story check out the link below.
